Three types of Partner Visas

​What is the 820/ 801 visa

The 820 and 801 Partner visas are designed for individuals in a genuine and ongoing relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. These visas allow the partner of an Australian citizen or permanent resident to live and work in Australia.  The 820 visa is often referred to as the 'onshore partner visa' as the applicant must be in Australia to apply for this visa.

 

820 Partner Visa (Temporary)

Purpose: The 820 visa is the temporary visa that allows the applicant to live, work, and study in Australia while their permanent partner visa application (801) is processed.

Eligibility: To be eligible for the 820 visa, the applicant must demonstrate that they are in a genuine and continuing relationship with their sponsor, who must be an Australian citizen, permanent resident, or eligible New Zealand citizen.

Inclusion of Children: Dependent children or stepchildren can be included in the 820 visa application, and if the visa is granted, they will have the same rights as the applicant.

 

801 Partner Visa (Permanent)

Purpose: The 801 visa is the permanent partner visa, and it is typically granted after the applicant has held the temporary 820 visa for a certain period and has demonstrated that the relationship remains genuine and ongoing.

Eligibility: You can only apply for the 801 visa after your 820 visa application has been finalized and granted. After holding the 820 visa for two years, applicants will be assessed for the 801 visa based on their continued eligibility and the stability of the relationship.

Permanent Residency: Once the 801 visa is granted, it provides the applicant with permanent residency in Australia, which includes access to Medicare, the ability to live and work in Australia indefinitely, and the possibility to apply for Australian citizenship in the future.

Family Members: Both the 820 and 801 visa applications can include dependent children and stepchildren. If the primary applicant's visa is granted, the children will also receive the same rights, such as the ability to live and study in Australia.

 

Application Process

The applicant must submit both the temporary (820) and permanent (801) visa applications at the same time. After the 820 visa is granted, the applicant can live and work in Australia while waiting for the 801 visa decision. The 801 visa application is usually processed after a waiting period (often two or more years from the submission of the 820 visa application), at which point the applicant may be granted permanent residency.

  • Your partner MUST be an eligible Australian citizen/permanent resident or an eligible NZ citizen

  • You must provide police checks for every country that you have lived in for 12 months  in the last 10 years.
